After Lehman Brothers bankruptcy' filing on September 15, 2008, Taiwan has over 50,000 people fell victims to the Lehman scandal, many asked for my help in this matter as the original documents including the Prospectus of the Lehman structure notes were in English. The victims thought I would be in a better position to explain to the courts the details of their cases since Lehman notes are basically Wall Street products.

I therefore applied to the Taichung Bar Association, the Tainan Bar Association and the Kaoshiung Bar Association in order to represent the victims. Except Kaoshiung Bar, both Taichung Bar and Tainan Bar acted unfriendly.

Regarding the Taichung Bar, after my payment of the application fees on December 24, 2009 , Taichung Bar simply ignored me for three months. They did not give me any notice of acceptance to the Bar, they did not send me any certification of my membership to the Bar. A Tainan local lawyer would have such certificate as soon as he or she joins the Bar. When I finally called Tainan Bar today to withdraw my application six months later, a Mr. Chen told me I was the only foreign lawyer who applied to Taichung Bar and they really did not know what to do with me.

Taichung court judges had no idea whether to let me represent the clients or not. When a small claim court judge approved my representation of my client, the lawyer representing the other side, Taichung Bank, screamed at me for taking away their chances of erning more legal fees and he reported me to the Taipei Lawyers Association. Since the small claim court judge can approve my representation according to the Civil Code, I did not violate any law, further, the other lawyer simply did not have a standing to report me. I have not heard from any one since.

I am sorry that even though Taiwan wants to join the UN, the WTO and WHO, it remains hostile to foreign lawyers and close-minded to the international legal communities. Without improving its treatment of foreign lawyers in Taiwan , Taiwan 's export dependent economy can expect to lose even more grounds in the near future.
